General conditions for consumers

1. Scope

These general conditions apply to all orders and deliveries between Animal Deli doo, Horvatova ulicca 80 A, 10000 Zagreb, Croatia, (hereinafter referred to as “Animal Deli”) and its customers via the online store www.animaldeli.com.

2. Order, conclusion of the contract, contract documentation, limitation of quantity, resale

Order process

Animal Deli offers customers an extensive range of products for pets. By clicking on the product or article name, the customer is directed to the product page, where details about the product's design, size or flavor variants are described. By selecting the desired quantity and then clicking on the shopping cart, the product is added to a virtual shopping cart.

By clicking on the "Shopping cart" button, located in the upper right corner of the online store, the customer navigates to an overview page where they can check the contents of the virtual shopping cart and make changes if necessary.

If the customer does not want to add more items but wants to complete their purchase, they click on the "Go to checkout" button. Customers already registered with Animal Deli can now log in by entering their email address and password. New customers have the option to register or continue their purchase without opening a customer account. In this case, the customer fills in their address and payment information on the next page.

By clicking the "Continue" button, the customer comes to the penultimate step in the ordering process, "Overview". Here, the customer receives a summary of the order with information on price (including statutory VAT) and delivery information.

The order is placed by clicking on the button "Complete purchase". This means that a binding offer has been submitted.

Animal Deli does not charge any fees for the use of electronic communications, but the customer may incur applicable fees associated with the use of these third party services (eg, mobile operator, internet service provider).

3. Entering into a purchase agreement

a. The products offered in the store are sold exclusively to non-commercial private individuals, that is, only to consumers who enter into that legal document for purposes that cannot be attributed to their commercial or independent professional activity. Offers displayed on our website www.AnimalDeli.se are therefore not aimed at companies. Companies are defined as natural or legal persons or partnerships with legal capacity which, when entering into a legal act, act in the exercise of their commercial or independent professional activity.

b. The images of the products in the online store are intended as an illustration of the products and do not constitute a binding sales offer. Customers complete the ordering process by clicking on the button "Complete purchase" and thereby submit a binding offer to enter into a purchase agreement. The customer then receives an automatic order confirmation via e-mail (order confirmation). This order confirmation does not constitute an acceptance of the customer's offer. An agreement with Animal Deli is only concluded when Animal Deli sends the ordered product to the customer and the delivery is confirmed via e-mail (delivery confirmation).

c. Notwithstanding point b. above, an agreement is already concluded when Animal Deli sends payment information if the customer chooses to pay in advance. This payment information is sent to the customer within 24 hours of the order being shipped. The order confirmation does not constitute payment information. In the case of advance payment, the invoice amount is due immediately upon receipt of the payment information and must be paid within 7 days of receipt via bank transfer to one of the accounts specified in section 8.1. It is the registration of the invoice amount on our account that determines whether the payment deadline is met. If no payment is registered to any of the specified accounts within 7 days, the customer's order will be automatically cancelled.

d. The language of the agreement is in the local language.

Contract text

The contract text is stored by us until the order has been processed in its entirety, after which it is archived for storage in accordance with tax and trade legislation. After Animal Deli has received the order, the buyer receives a separate confirmation by email from Animal Deli containing the essential parts of the agreement, including the general terms and conditions in force at the time of the agreement. If you lose your documents related to your orders, please contact us. We are happy to send you a copy of your order information.

Limitation on Quantity and Commercial Resale

The goods offered are sold only in normal household quantities and only to adults. Commercial resale of the goods is not permitted. Animal Deli reserves the right not to accept contractual offers that appear to be made for commercial resale of goods.

Prices and shipping costs

All prices include statutory VAT and other price components but exclude any shipping costs.

If you order products from Animal Deli for delivery outside the EU, you may be liable for customs duties and taxes. These are charged when the package reaches the specified destination. Any additional customs clearance costs must be borne by you. We have no control over these fees. Customs regulations vary widely from country to country, so you should contact your local customs authority for more information.

4. Delivery

Deliveries under this agreement only take place within specified markets. Unless otherwise stated in the offer or product information, delivery takes place within 4 to 8 working days. The delivery period begins the day after the contract is concluded, except in the case of advance payment: in such cases, the deadline begins the day after payment for the goods is received. If the last day of the deadline falls on a Saturday, Sunday or an official holiday in the country of delivery, the deadline is automatically extended to the next working day. If any of the products ordered are not in stock, Animal Deli has the right to provide partial deliveries at its own expense, provided this is acceptable to the customer.

If Animal Deli cannot deliver the ordered product due to non-delivery from its own suppliers, but this is not Animal Deli's fault, Animal Deli has the right to withdraw from the contract. In such cases, Animal Deli shall immediately inform the customer and propose a comparable product. If a comparable product is not available or if the customer does not wish to receive it, Animal Deli shall immediately refund any payments made by the customer.

Deliveries within the EU are duty-free. For deliveries to countries outside the EU, the customer is responsible for customs duties, taxes and other possible charges.

If ordered products are damaged during delivery, we ask the customer to contact Animal Deli's customer service without delay. Animal Deli then gets the opportunity to make a complaint to the carrier or the insurance company regarding the damage. The customer's right to statutory warranty obligations is not affected if transport damage is not reported.

In order to fulfill the customer's order, Animal Deli must forward the customer's email address and, if available, a telephone number to the delivery company tasked with delivering the goods. This is part of the agreement with Animal Deli. The customer has no right to object to this. For more information, see our privacy policy.

5. Reservation of ownership rights

The goods remain the property of Animal Deli until full payment has been made. Before ownership is transferred, it is not permitted to pledge, pledge, process or transform the goods without Animal Deli's approval.

6. Right of withdrawal

Consumers have a statutory right of withdrawal when entering into distance contracts. Animal Deli provides the following information in accordance with the statutory template. A consumer is any natural person who enters into a legal act for purposes which mainly fall outside their commercial or independent professional activity.

Right of withdrawal

You have the right to withdraw from this agreement within 14 days without giving any reason.

The cooling-off period expires 14 days after the day on which you, or a third party appointed by you (other than the transport company), physically receives the goods.

To exercise your right of withdrawal, you must inform Animal Deli of your decision to withdraw from this Agreement by means of a clear notice (eg a letter sent by post or email). You can use the attached cancellation form template, but it is not mandatory.

In order to meet the time limit of the withdrawal period, it is sufficient that you send your notice to exercise the right of withdrawal before the withdrawal period has expired.

Effects of exercising the right of withdrawal

If you withdraw from this agreement, we will refund all payments we have received from you, including delivery costs (with the exception of the additional costs incurred if you have chosen a delivery type other than the cheapest standard delivery offered by us), without undue delay and within 14 days at the latest from the day we were informed of your decision to withdraw from the contract. The refund will be made using the same means of payment that you used in the original transaction, unless you have expressly agreed otherwise; in which case you will not be charged any fees for the refund. We may withhold the refund until we have received the goods back or until you have provided proof that the goods have been returned, whichever occurs first.

The goods must be returned without undue delay and no later than 14 days from the day on which you notified us of your decision to withdraw from the contract. The deadline is considered to have been met if you send the goods back before the 14-day period has expired.

We are responsible for the cost of returning the goods. You are only responsible for any reduction in value of the goods that occurs due to handling other than what is necessary to determine the nature, characteristics and function of the goods.

Exemption from the right of withdrawal

The right of withdrawal does not apply to the delivery of goods that are not pre-manufactured and that are manufactured according to the consumer's individual choice or specification or that are clearly adapted to the consumer's personal needs.

The right of withdrawal also does not apply to goods that can quickly deteriorate or have a short shelf life, which are not suitable for return for health protection or hygiene reasons if the seal has been broken after delivery, or which after delivery have become inseparably mixed with other goods.

7. Warranty and Liability

The statutory warranty provisions apply.

We want to make it clear that our CBD-enriched pet food is not intended to replace professional veterinary care. Although CBD may have benefits for some animals, it is important to understand that each animal's health condition is unique and may require individual assessment and treatment by a veterinarian.

We strongly recommend that pet owners consult a veterinarian before using our CBD enriched pet food to ensure it is suitable for their pet's specific needs and health condition. We take no responsibility for any damage or adverse effects that may occur when using our CBD-enriched pet food without prior advice from a veterinarian.

8. Payment methods, Discounts, Interest on Late Payment and Other Delayed Damages, Invoices

1. Payment methods:

a. Direct bank payment

Payment takes place directly from your bank. When ordering, you are redirected to your internet bank to complete the payment. After completed payment, you will automatically return to the Animal Deli website.

b. Card payment

When paying by card, the card is debited within a week after the goods have been shipped. We accept Visa and Mastercard.

c. Traditional bank transfer

If you prefer to pay by bank transfer, payment must be made within 7 days of receiving your order confirmation. Please note that payment via postal order is not possible. For more information about bank transfer, please contact our customer service.

d. Invoice payment

We offer invoice payment for registered customers who regularly shop with us and have placed at least two orders. However, in some cases or depending on the goods you have chosen to order, we cannot offer invoice payment. This is an automated process and our customer service cannot change the payment method to invoice. We reserve the right to assess the credit risk with the help of external credit reporting companies. More information can be found in our privacy policy.

When paying an invoice, the customer undertakes to pay the invoice amount within 14 days after receiving the goods. The invoice is considered paid when the amount is registered on Animal Deli's account.

e. PayPal

PayPal is an account-based payment system where you can send and receive payments online via credit card or bank account. PayPal offers safe and easy payment. If you do not already have a PayPal account, you can create one in connection with your order.

f. Payment via Apple Pay

Apple Pay is available as a payment method for iOS devices in our app and mobile webshop. You can choose this payment method at checkout. Payment with Apple Pay is available through Safari, and you can pay with a linked payment card. Payment is made directly via your Apple account. Once you have placed your order, you will be directed to Apple to approve the payment of the order value. Once we have received information about your approval, delivery will begin according to the specified delivery time for the products.

Depending on the payment method you selected in Apple Pay, the actual invoice amount, less any discounts, coupons, etc., is charged immediately after the goods are shipped.

g. Klarna

In collaboration with Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, we offer the payment options Klarna Pay later and Klarna Slice it. Payment is made directly to Klarna.

With Klarna Pay later, customers can buy their goods now and pay within 30 days of the delivery of the goods or, in the case of the purchase of other services, upon the provision of the service. Klarna sends the invoice to the customer via e-mail.

With Klarna Slice it, customers can pay the order amount in monthly installments. The due date is determined according to the installment schedule specified during the purchase process and sent by Klarna via e-mail.

The payment methods Klarna Pay later and Klarna Slice it are not available for all offers and require, among other things, an approved credit check by Klarna Bank AB (publ).

2. Discounts

Please pay attention to the special conditions that apply to discounts or gift cards, such as minimum order amount, validity period, etc. Gift cards or other discounts can only be redeemed at the time of purchase. It is not possible to have a gift card or other discounts paid out in cash or use them afterwards. Only one gift card, discount code or order/customer related discount can be redeemed per order.

3. Invoice

Animal Deli has the right to invoice the customer electronically. Electronic invoices are sent to the customer via email as a PDF file. The invoiced value added tax does not give the customer the right to deduct input VAT.

4. Interest in case of late payment and other delay damages

In the event of a delay in payment, Animal Deli has the right to add late payment interest to the purchase price. If Animal Deli has evidence of greater damage resulting from the delay, we reserve the right to demand higher compensation.

9. Data protection

Animal Deli is very careful about protecting its customers' data. You can request Animal Deli's privacy policy and data protection information from info@animaldeli.com.

10. Marketing and customer communication

If the customer enters into a purchase agreement for a product or service with Animal Deli and provides their email address, Animal Deli may use this email address for direct marketing of similar goods or services.

The customer has the right to object at any time to the use of the e-mail address for this purpose without incurring any costs in addition to the transmission costs according to the basic rate.

Each email contains an unsubscribe link for this purpose. Alternatively, an objection can be made at any time via e-mail to info@animaldeli.se.

12. Animal Deli Subscription

1. General

The Animal Deli Subscription (hereinafter: Subscription) enables registered customers to automatically order subscription-eligible products at regular intervals without having to make repeated manual entries. Temporary promotional products are excluded from the subscription. Orders that are already confirmed or completed and contain a subscription-eligible product can be converted to a subscription in the customer's account under “My Orders.”

Each automated order as part of the subscription constitutes a binding offer to Animal Deli to enter into a purchase agreement. The agreement with Animal Deli is concluded only when Animal Deli sends the ordered item to the customer and confirms the delivery via another e-mail within five working days after the automated order is received (delivery confirmation). If the customer does not receive a delivery confirmation within this period, no contract is entered into with Animal Deli.

Before an automated order is processed, Animal Deli sends a reminder email that allows the customer to cancel or change the order.

2. Animal Deli Subscription Discount

Animal Deli offers a subscription discount on the regular, current price for specific products. Information about the size of the discount and products that are eligible for subscription can be found on the "subscription information" page. The subscription discount that the customer receives is the discount that applies to subscription products at the time the order is processed.

Certain details about the subscription and the product (including price, discount and availability) may change over time. Each subscription order is subject to the subscription and product terms and conditions current at the time. Animal Deli therefore reserves the right to change the subscription discount at any time. The subscription discount cannot be combined with other discounts.

3. Availability of the product

If an ordered product is not available on the scheduled delivery date, the order for that product will automatically be cancelled.

4. Term, changes and termination

The subscription has no binding period. Delivery intervals can be chosen freely in weeks but must be a minimum of four (4) and a maximum of twelve (12) weeks.

Changes, interruptions and termination of the subscription can be made at any time via the customer's account under "My subscriptions." Animal Deli can change these subscription conditions at any time by publishing the changed conditions on AnimalDeli.se and informing the customer in advance of significant changes.

By continuing the subscription, the customer accepts these changes. If the customer does not accept the changes, they must cancel their subscription. More information on how to cancel your subscription can be found here. Animal Deli has the right to terminate the agreement at any time without written justification.

5. Payment methods

The products ordered as part of the subscription can only be paid for by debit/credit card or PayPal. The prerequisite for payment by debit/credit card and PayPal is that the information on the customer's account is current and complete.

6. Miscellaneous

If any provision of these terms, as amended, should be or become invalid or unenforceable for any reason, this will not affect the validity or enforceability of the remaining terms.

13. Online Dispute Resolution

The European Commission provides a website (ODR platform) for online dispute resolution (ADR) between businesses and consumers. The ODR platform can be accessed via the following link:

Animal Deli is neither obligated nor willing to participate in a dispute resolution system.

14. Final provisions

If any provision of these Terms should be or become invalid or unenforceable, this will not affect the validity or enforceability of the other provisions of these Terms.

Croatian law applies with the exception of the UN Convention on Contracts for the International Sale of Goods (CISG). This choice of applicable law applies only to the extent that the protection provided by mandatory provisions of the law of the country where the consumer has his habitual residence at the time of his order is not revoked.
